Terms & Conditions
Payment for, or participation in, any Birding Man Wildlife Tours (“BMWT”) trip constitutes acceptance of the following Terms and Conditions. Please read them carefully. These policies ensure clarity, safety, and fairness for all guests while allowing us to deliver the high-quality, conservation-minded travel experiences we’re known for.
1. Physical Ability, Assumption of Risk & Participant Responsibilities
By joining a Birding Man tour, you affirm that:
You are in good physical condition and able to participate safely in outdoor activities including walking, hiking, birding, wildlife viewing, and travel over uneven terrain.
You have asked and received answers to all questions about the activities involved.
If you are a mobility-reduced traveler or require accessibility accommodations, we invite you to inquire about our Accessible Birdwatching Tour or discuss your needs with us prior to booking. We are happy to help identify the trip best suited to your comfort, safety, and enjoyment.
Outdoor travel inherently involves risks—both expected and unexpected—including, but not limited to: slips and falls, loose rocks, ice, snow, water hazards, wildlife encounters, extreme temperatures, altitude, insects, hazardous plants, weather events, and transportation risks.
By participating, you voluntarily accept all risks of loss, damage, injury, illness (including infectious disease), or death. You acknowledge that you are responsible for obtaining sufficient medical, travel, and evacuation insurance to cover unforeseen circumstances.
Participants agree to follow all safety instructions from BMWT guides and staff. BMWT may remove any participant from a tour—without refund—if their behavior threatens group safety or enjoyment, or if they engage in illegal activities.
2. Liability Release & Indemnification
To the fullest extent permitted by law, you agree to release and hold harmless:
Birding Man Wildlife Tours, LLC, its owners, employees, guides, contractors, agents, volunteers, affiliates, and partners (“Released Parties”) from any liability arising from your participation in any BMWT tour or activity.
This includes liability related to:
Personal injury, illness, or death
Property loss or damage
Delays, changes, or interruptions
Any negligence by Released Parties
You agree not to pursue legal claims against BMWT for such matters, and you will indemnify BMWT for any costs (including attorney’s fees) arising from claims connected to your participation.
These Terms & Conditions are governed by Colorado law. Any disputes shall be resolved exclusively in the courts of Denver County, Colorado.
3. Required and Recommended Insurance
BMWT strongly recommends comprehensive travel insurance for all tours, and particularly for international travel. Appropriate coverage may include:
Medical and emergency evacuation insurance
Trip cancellation/interruption insurance
Coverage for illness (including COVID-19), injury, or family emergencies
Lost, damaged, or stolen baggage and personal items
Additional lodging or transportation costs due to delays, illness, or quarantine
BMWT is not responsible for costs incurred due to illness, injury, flight disruptions, weather, civil unrest, natural disasters, or any other unforeseen circumstances.
We recommend purchasing travel insurance promptly after enrolling in a tour.
4. Payments & Deposits
A non-refundable $1,000 deposit per participant is required to secure a spot on any tour. A tour is considered secured only after the deposit or full payment has been received.
Full payment is due 90 days prior to departure, unless otherwise noted.
Guests may pay by credit card, bank transfer, check, or designated electronic payment methods (such as Zelle or Venmo). Credit card payments incur a 2.9% processing fee. Payment method details, including any applicable fees, will be provided during booking.
Specific tours may use third-party booking platforms for payment processing (e.g., WeTravel). Details will be provided for each tour.
A tour is considered confirmed only after the minimum group size has been reached and BMWT has notified participants in writing.
Late Bookings and Exceptions: Guests who join a tour within 90 days of departure are required to pay the full trip cost at the time of booking. BMWT may adjust payment deadlines for specific tours that have not yet reached minimum group size, and will communicate any such changes clearly to enrolled participants.
5. Tour Confirmation & Minimum Group Size
Most Birding Man Wildlife Tours departures require a minimum number of participants to operate. A tour is considered “confirmed to run” only when this minimum has been reached and BMWT has notified all enrolled participants in writing.
BMWT reserves the right to cancel a tour if minimum enrollment is not met. In such cases, all payments made to BMWT will be fully refunded, or participants may choose to transfer their payments to another BMWT tour.
Participants are strongly advised not to book flights or non-refundable travel arrangements until BMWT has confirmed that the tour is officially proceeding.
6. Cancellation Policy
If BMWT Cancels a Tour
If a tour is cancelled due to low enrollment, weather, safety concerns, COVID-19, or any unforeseen event, you may choose between:
A full refund, or
Transferring your payments to another tour
If You Cancel Your Participation
More than 90 days before departure: Full refund
Within 90 days of departure: Payments are non-refundable unless your spot is filled by another participant. If your spot is filled, all payments will be refunded minus a $250 administrative fee.
Travel insurance is strongly recommended to protect your investment.
7. Itinerary Flexibility
BMWT reserves the right to adjust an itinerary before or during a tour when necessary due to conditions beyond our control, including:
Weather
Road closures
Lodge availability changes
Flight delays
Wildlife activity
Safety considerations
Such changes are made to ensure the best possible experience for the group.
8. Travel Documents & Health Requirements
Guests are solely responsible for ensuring they have all required documents for travel, including:
Valid passport
Visas (if required)
Vaccination documentation
Medical certificates
Any other destination-specific entry requirements
BMWT will offer guidance when possible but cannot guarantee entry or compliance for any individual.
9. Pricing & Currency
BMWT reserves the right to adjust tour prices due to:
Currency exchange fluctuations
Fuel surcharges
Supplier changes
Unexpected operational costs
Prices are confirmed at the time of full payment unless otherwise noted.
10. Smoking Policy
Smoking is prohibited inside tour vehicles and indoor spaces. When smoking outdoors, please be respectful and move away from the group.
11. Damage to Property
Participants are responsible for any damage to BMWT vehicles, equipment, lodges, or other property caused by their intentional or negligent actions.
12. Photo & Video Use
By participating in a BMWT tour, you grant permission for BMWT to use photos or video images taken by guides, participants, or third parties during the tour for marketing and promotional purposes in any format. No compensation will be provided.
If you prefer not to appear in photos, please inform your guide at the start of the tour.
13. Acceptance of Terms
By submitting payment, signing required forms, or participating in any Birding Man Wildlife Tours trip, you acknowledge that:
You have read and understand these Terms & Conditions
You accept them voluntarily
You are of legal age and competent to agree
You understand that participation involves inherent risks
These Terms & Conditions apply to all tours offered by Birding Man Wildlife Tours.
